We make mistakes in our daily life, It is siad that we should learn from our mistakes, but some mistakes are huge and some can be very expensive so today i am going to discuss the legal aspects of mistake and cases where mistakes caused a huge loss to some people
The law is made to provide justice to the people, but there are very absurd judgements where one can say that the law was not fair and it didn't provided justice.
The first case is of Centrovincial estates v Merchant Insurane in which a person rent out a flat to two peole on a rent of 65,000 pounds and said a year later this rent is going to change but after a yea they mistakenly changed the rent to 62,000 pounds instead of saying 70,000 pounds. As you might think that this mistake is not a big one, later the person could tell them that i have made a mistake so can we change the rent
Not in this case the case went to the supreme court and the judges said that the contract was made between them and now this contract cannot be cancelled.
As we can see that the ruling of the court in this case was totally unjust as it was a normal mistake that we may also do in our daily doings, but the courts are not for sympathy as they do what they want.
As the courts are not always wrong i don't want to say that the judges are wrong all the time, there are times when judges also gave very good decisions and saved the person to loose a huge amount
The case is of Scriven Bros v Hindley where there was an auction going on of hemp and tow . As hemp is expensive and the tow is cheaper, so when the auction catalogue arrived the prcies of both the goods were shuffled
So the person opted for 1000 hemp instead he was buying tow, So the contrac was done. later it was realized that the auction catalogue was not right.
This case went to the supreme court and if we followed the decision in above case the person was at loss, but the courts didn't do that instead they said that it was the mistake of the auctionner that he didnt made the auction catalogue right so there was no contract made between them hence justice was served here
So after these cases we can say that the justice depends upon your luck, because in the first case the judges didn't follow the law they simply did what they wanted if the law was followed correctly the person would not be made pay that losses.
So Be aware don't make mistakes that could land you in such trouble. you don't know that mistakes can land you in jail as well.
