The recent hip replacement recall has stirred up quite a bit of concern amongst those who have endured the surgical procedure only to find out that their device may now be faulty. And, who wouldn’t be concerned? Having a hip replacement is a major surgery that individuals often take months to recover from. Of course, this has prompted many patients to get in touch with their physicians in order to find out or confirm exactly which device was placed during their surgery.
The ugly truth is that there are now more than 90,000 devices that have been recalled. The numbers have not yet been released as to how many of these are actually in use vs. how many are being pulled from the shelves of hospitals across the United States. The recall includes the DePuy Hip Replacement device systems, which are the DePuy ASR XL Acetabular System and the ASR Hip Resurfacing System; however, the Zimmer Durom Cup, the Stryker Trident PSL, or the Stryker Trident Hemispherical Acetabular Cup devices have also made the list of recalled implants.
Though there are other device manufacturers involved, the Johnson & Johnson subsidiary, DePuy, seems to be responsible for a large part of the product recall. The nearly 13% failure rating of the DePuy ASR XL left DePuy no choice but to finally announce a recall on the product in late August.
Some of the patients that have these faulty implants are abstaining serious injuries due to the implant failing, which has caused dislocations, hip fractures, popping and clicking, and many are also dealing with chronic pain and swelling. Unfortunately, these are simply some of the more common signs. There is no set time frame from when the signs start (or even appear at all) to when the implant fails, so those that have a faulty implant may not know it until it’s too late.
For those that have experienced an injury due to a faulty device or are currently experiencing any of the above mentioned signs, it is wise to consult with an experienced hip attorney. Vanguard and Partners is the law firm that has been retained to take action against DePuy, Zimmer, and Stryker due to these failing devices; however the law only allows a small window of time for claimants to file. It is highly recommended that, if you feel that you are a victim of one of these faulty products, you get in touch with an experienced attorney as soon as possible.
