As of this writing, there are three levels of DUI offenses. The first level is when a driver's blood alcohol content is .08% to .099%. The second level is when a driver's blood alcohol content is .10% to .159%, and the third level is when a driver's blood alcohol content is .16% or higher in a driver's body. It depends on the level of blood alcohol concentration in one's system and the number of DUI offenses involved on what the penalties will be. All three levels are required to have a Court Reporting Network (CRN) evaluation. Alcohol Highway Safety School (AHSS) is required for both first and second driving under the influence offenders.
For first time DUI`s with a first level blood alcohol content, the penalties could be anywhere up to a 6 month probation and a $300.00 fine. It is also possible that first time DUI offenders will be required to have a Drug and Alcohol (D&A)assessment.For the first offense the offender does not lose his or her license or serve any time in jail. Second time DUI offenders will serve at least five days in jail, up to a maximum of 6 months, and receive a $300.00 to $2500.00 fine. Their license will be suspended for twelve months and they are required to have a CRN, AHSS and D&A.They will also be required to install an Ignition Interlock for twelve months. A third and fourth time offense entails a compulsory jail sentence of ten days and can be up to two years. The fine can be anywhere from $500.00 to $5000.00. Offenders will also be required to have a CRN and D&A plus install an Ignition Interlock for twelve months.
For first time DUI`s with a second level blood alcohol content, there is a compulsory forty-eight hour jail time with a possibility of a maximum of six months. Offenders will also be required to pay a fine of $500.00 to $5000.00 and are required to have a CRN, AHSS and possible D&A. DUI`s will have their license suspended for twelve months, with a possibility of obtaining an Occupational Limited License (OLL) after serving two months of the suspension. Second time DUI offenders will serve thirty days jail time with a maximum of six months. The fine involved at this level is $750.00 to $5000.00. Their license is suspended for twelve months and they are required to have a CRN, AHSS, D&A and to install an Ignition Interlock for twelve months.
For third time offenders at this level, there is a compulsory ninety day jail time up to a maximum five year sentence together with a fine from $1500.00 to 10000.00. Their license will be suspended for eighteen months and they will be required to have a CRN, D&A and install an Ignition Interlock for twelve months. Fourth time offenders will serve a compulsory one year prison term up to a maximum of five years. The fine involved will be $1500.00 to 10000.00 and the driver`s license will be suspended for eighteen months. They will be required to have a CRN, D&A and to install an Ignition Interlock for twelve months.
For first time DUI's with a third level blood alcohol content, there is a compulsory seventy-two hour jail time with a possibility of a maximum of six months. The fine is from $1000.00 to $5000.00 and DUI drivers are required to have CRN, AHSS and a full D&A, and will lose their license for twelve months. There is a possibility of obtaining an OLL after two months of the suspension has been served. For a second offense, DUI`s will serve a compulsory ninety day jail sentence up to a maximum five years, with a fine from $1500.00 to $10000.00. The driver's license will be suspended for twelve months and the driver will be required to have a CRN, AHSS, D&A and to install an Ignition Interlock for twelve months. Third time offenders will serve a compulsory one year prison term up to a maximum of five years and will be required to pay a fine of $2500.00 to $10000.00.
