Largest Medical Malpractice Case in Santa Clara County won with the Help of Bovino and Associates

The Palo Alto Medical Foundation Group was hit with a hefty malpractice verdict after Robyn Frankel underwent an unnecessary medical procedure that caused her to stroke and an immediate coma.

The Bovino and Associates Law Firm obtained a $22 Mil verdict that included a capped $6 mil for pain and suffering.48 yr old Robyn Frankel suffered chronic migraines. Her primary care physician recommended her for a consult with neurosurgeon Dr. Paul Jackson from the Palo Alto Medical Foundation Group. After a brief consult Frankel received a letter telling her to attend an angiogram test at the Stanford Hospital. During the procedure she was injected with a dye into her vein to examine what the physician believed to be the focal cause of her migraines. Frankel was never notified of the method or risks of the angiogram. While the dye was injected she suffered a stroke that placed her in a comatose state for 6 weeks. According to Bovino the defendants lost all credibility after consecutively arguing that Dr Jackson denied ever ordering the procedure and blamed Stanford Hospital for its negligence. During court proceedings a Stanford nurse testified she had received a fax from Dr. Jackson ordering the allege angiogram. The Stanford nurse, who had previously received a successful spinal surgery from Dr Jackson, cried during her testimony and stated “It breaks my heart that my doctor, whom I have entrusted my life to and whom I think the world of, is not being truthful”.During the proceedings Lawyer David Bovino had thousands of exhibits for Frankel's case, but the most compelling piece of evidence was the fax, which stated that Frankel was to undergo the procedure. “We had it up on screen quite a bit. It was burned into all of the jurors’ minds,” said Bovino.The jury found Palo Alto Medical negligible of Ms Frankel's care, and that negligence had caused her irreparable harm. Sta. Clara Superior Court Carol Overton gave the final judgment March 19, 2012, giving the largest medical malpractice verdict in the history of Sta. Clara County. The large verdict is due to Frankel’s young age, and for the long life she will suffer because of her disabilities. Robyn Frankel was so thankful of her attorneys, David Bovino and Jeffrey Mitchell along with the team of legal counselors for giving new hope and life to her.
