Health and Social care is a very wide sector and it covers different policies and procedures which exist or they are implemented to make sure that the service users are safe and they are protected. In this article, it will be discussed that how the present legislations and the sector skills have an impact on the policies and practices of the organisation with the objective of promoting the rights of the service users of the health and social care sector.
Legislations are the laws which are made by the governing bodies so that they can regulate and restrict the activities of the organizations. These legislations keeps on changing so that the service users can be protected and their rights are served properly.
Being a care worker in a residential home, I am required to conduct an induction program for the new hired workers and to train them that how they can empower the service users so that they can feel independent. Legislations provide guidance to others that how the things should be managed in the organisation. The legislations in health and social care include:
The Human Rights Act, 1998: This was first introduced in 2000 in United Kingdom and this is for the genuine rights of the human beings so that they can fight for their own rights, equality, fairness and respect. Every service user will be empowered by this legislation because it promotes the rights of the service users and give right to complain and speak if they feel anything about the services.
Care standards Act, 2000: This is introduced by the Care Standards Commission and it also empowers the service users. This is the legislation which includes patients, health managers, volunteers, etc and the main aim of this is to regulate the activities in the social care and the standards are improved. They have the responsibility to regulate the health and social care unitslike Hospitals or care homes. It includes the personal care, choice of home, complaints of the service users, providing protection, etc. to empower the service users.
Data Protection Act: The service users will feel empowered when their privacy and confidentiality will be maintained by the health and social care providers. (Commision, 2015) This act includes the protection of the data of the service users. There are some principles which are to be followed to understand this act. Some of the principles are:
